Official Rules and Code of Conduct
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
- Eligibility: The Water Remixer Challenge (the “Contest”) is open to anyone above the age of eighteen (18) years old at the time of entry. All employees of UNIVERSITY OF MIAMI on behalf of the Knight Center for International Media at the School of Communication (“University of Miami” or “1H2O”), THE INDEPENDENT TELEVISION SERVICE, INC., (“ITVS”), NewsU, LinkTV Know the News, and all of their respective parent, subsidiary and affiliate companies, distributors, advertising and promotion agencies and any other agency that provides services in connection with this Contest, as well as the immediate family (spouse, parents, siblings and children and their respective spouses, regardless of where they reside) and household members of each such employee, whether related or not, are not eligible to participate in this Contest. This Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation in this Contest constitutes participant’s full and unconditional agreement to these Official Rules and the University of Miami’s , ITVS’s and decisions, which are final and binding in all matters related to this Contest. Winning the prize is contingent upon fulfilling all requirements set forth herein.
- Contest Operators: University of Miami, ITVS and NewsU, and LinkTV Know the News.
- Timing: The Contest begins on April 15, 2009 at 9:00 a.m. Eastern Time ("ET") and ends on August 15, 2009 at 11:59 p.m. ET (the "Promotion Period"). University of Miami's computer is the official time-keeping device for this Contest.
- How to Enter: During the promotion period, visit http://www.1h2o.org/contests/onetake/ to enter your video. Video monologues can be recorded in any language using any video recording device and can be submitted by uploading files in any major digital video format using our submission form. All entries must be in one take. That is to say the entire monologue should be one continuous shot with no edits and/or visual or graphic overlays. The person represented in the video must also be the author of the monologue. All entries must be subtitled in at least one (1) language using NewsU, and LinkTV Know the News.com functionality. Entries with more than one language subtitled will automatically qualify for the Special Prize. Your submission must not exceed 2 minutes. You will be able to upload your entry on April 15, 2009. The competition will be open until August 15, 2009 and prizes will be announced on September 30, 2009.
- Entrant’s Representations. By entering, Entrant represents and warrants that the submitted video (i) is the Entrant’s original work and has neither been published; (ii) satisfies the Official Rules and Code of Conduct; (iii) does not infringe any of the intellectual property and other rights enumerated herein; (iv) is not subject to any third-party contract or agreement and will not require the 1H2O to pay any fee for the submitted video’s use; (v) and contains no offensive content or content that will bring 1H2O into disrepute. Violation of these representations may result in disqualification in 1H2O’s sole discretion.
- Limit. Entrant may enter the Contest one (1) time during the Promotion Period. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using same/multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification and all associated entries will be void. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player provided he/she is eligible according to these rules. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
- Review of Submissions: 1H2O will review all submitted remixes. Entries that do not comply with the Official Rules and Code of Conduct will be disqualified from One Take and will not appear. Decisions of 1H2O as to official entries are final and binding. 1H2O assumes no responsibility for disputes between persons claiming authorship of a submitted video.
- Prize: Parties will make available one 1st prize award of five-hundred dollars ($500.00), one 2nd prize award of three-hundred dollars ($300.00) and a three-hundred ($300.00) prize award for the video subtitled in the most number of languages. The Contest must occur between April 15, 2009 and August 15, 2009 (“Window”). The Parties shall facilitate administration of the Contest in accordance with applicable local laws and regulations and the official rules for the Contest attached hereto as Exhibit A (“Contest Rules”). All Contest winners shall meet minimum eligibility requirements and shall be required to sign the legal forms and releases required by the Parties, if any, prior to receiving any prize. Upon meeting all eligibility requirements, the Contest first prize winner shall receive the Five-Hundred Dollars ($500.00) in cash; the second prize winner shall receive Three-Hundred Dollars ($300.00) in cash. All other prizes, if any, shall be awarded in accordance with the Contest rules.
- Release: By participating, participant agrees to release and hold harmless the University of Miami, ITVS and NewsU, and LinkTV Know the News, and their respective parents, subsidiaries, affiliates, distributors, dealers, dealer advertising associations, advertising and promotions agencies, prize suppliers and any other agency that provides services in connection with this Contest, and each of their respective trustees, officers, directors, employees, representatives, students, contractors and agents and successors and assigns (the “Released Parties”) from and against any and all rights, claims and causes of action whatsoever that each participant may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from participant's acceptance, possession, use or misuse of the prize in the Contest, or his/her participation in the Contest, or his/her participation in any Contest. WINNER ALSO FURTHER ACKNOWLEDGES RELEASED PARTIES HAVE NEITHER MADE, NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR, ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZE OR THE CONTEST EXCEPT AS SET FORTH HEREIN.
- Publicity: Except where prohibited, participation in the Contest constitutes each winner’s consent to the use of each winner’s name, likeness, photograph, voice, opinions and/or hometown, state and entry by 1H2O on a non-exclusive basis for promotional, publicity, public relations and advertising or other purposes in any manner in any and all media now or hereafter known worldwide in perpetuity, without further payment, consideration, permission or notification and its parent, subsidiary and affiliated companies, and their advertising and promotion agencies and other designees’ use of each winner’s name, likeness, photograph, voice, opinions and/or hometown, state and entry for promotional, publicity, public relations and advertising or other purposes in any manner in any and all media now or hereafter known worldwide in perpetuity, without further payment, consideration, permission or notification.
- Likeness. Entrant indicates that he/she is giving 1H2O permission to use his/her (first and last name), city, likeness, photograph, voice, opinions and/or hometown, state and entry in press releases, website announcements (on www.1H2O.org) print and web banner advertisements, and each person submitting the video represents and warrants that he/she is the sole creator of the video and hereby licenses 1H2O to use, distribute, and publish the video. No fee or compensation will be paid in addition to the receipt of the prize itself. This permission/representation/warranty/license is in perpetuity.
- Property Rights: Submitted videos must not infringe third party intellectual property rights, must be suitable for publication and the right to submit it must not infringe any third-party copyrights, trademarks, patents, trade secrets, contract or licensing rights, rights of publicity or other legal or moral rights. Submitted videos to 1H2O shall not contain any music that is not in the public domain and shall not defame, disparage or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights. Videos submitted to 1H2O must be suitable for publication in a public forum (as determined by 1H2O in its sole discretion); may not contain nudity, profanity, or representations or threats of physical violence; and may not reflect negatively on the Contest Entities.
- Assignment of Rights. Submitted videos become the exclusive property of 1H2O and Entrant unconditionally assigns and transfers to 1H2O all rights, title, interest and claims in the video, including, without limitation, the copyright therein, and waives any moral rights in the video. 1H2O has the right to post, use, broadcast, display, publicly perform, alter, edit, assign, create derivative works there from or dispose of such entries in whole or in part (including clips or still frames from videos) however it sees fit in any and all media without limitation as to time or territory without approval of Entrant. Entrants will sign all necessary documents granting 1H2O rights in videos if required by 1H2O.
- General Conditions: University of Miami reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Contest, as determined by University of Miami in its sole discretion. If terminated, University of Miami may, at its sole discretion, select winners from among all eligible, non-suspect entries received during the Promotion Period. University of Miami reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, University of Miami reserves the right to seek damages from any such person to the fullest extent permitted by law. Any failure by University of Miami to enforce any term of these Official Rules or any applicable laws shall not constitute a waiver of such right. If any provision of these Official Rules is found by a court of competent jurisdiction to be invalid, then participant, University of Miami and the court shall endeavor to give effect to the intent reflected in that provision, and the remaining Official Rules shall retain their full force and effect.
- Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by participants, printing or typographical errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical, computer or network failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) any other error or problem which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, garbled, delayed, misdirected, damaged or stolen entries; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Contest or receipt or use or misuse of any prize (including any injury or harm resulting from use of the automobile). If for any reason an participant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, participant’s sole remedy is another entry in the Contest, provided Contest has not be discontinued. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed University of Miami reserves the right to award only the stated number of prizes by a random drawing from among all legitimate, un-awarded, eligible prize claims.
- Disputes: This Agreement shall be considered as having been entered into in the State of Florida, United States of America, and shall be construed and interpreted in accordance with the laws of that state. In any action or proceeding arising out of or relating to this Agreement (an “Action”), each of the parties hereby irrevocably submits to the non-exclusive jurisdiction of any federal or state court sitting in Miami, Florida, and further agrees that any Action shall be heard and determined in such Florida federal court or in such state court. Each party hereby irrevocably waives, to the fullest extent it may effectively do so, the defense of an inconvenient forum to the maintenance of any Action in Miami, Florida.
- Participant's Personal Information: Information collected from participants is subject to ITVS’s Privacy Policy, Privacy Policy and University of Miami’s Privacy Policy.
- Winners List: Winner List requests will only be accepted after the promotion end date (listed above) and no later than September 30, 2009. For the winner list, send an email with subject line: “One Take, Winner List Request,” to 1H2O@miami.edu.

Judging Criteria
Entries will be judged by five criteria:- Clarity of sound and picture – The audio and images do not need to be of broadcast quality, but are they clean and clear?
- Quality of writing – Are the facts verifiable and written in a compelling way?
- On-camera delivery – Is the on-camera performance effortless and convincing?
- Passion/Conviction of ideas – Is the delivery of the ideas believable? Does it inspire the viewers?
- Innovation – Is the video creatively executed? Are the creative risks effective?
